'I AM NOT AWARE OF MORNA'S CASE'

The National Chairman of the People’s National Convention (PNC), Alhaji Ahmed Ramadan, says he or the party is not aware that its General Secretary Bernard Mornah has filed a suit at the Supreme Court to challenge the legal instrument used to regulate the just-ended general elections.

Alhaji Ramadan told an Accra-based radio station that the party was praying for Mr. Mornah in his endeavour although it was not informed about the move.

On Monday December 30, 2012, Mr. Mornah filed a suit at the Supreme Court asking that Constitutional Instrument (C.I.) 74 be declared ‘null and void’.

Mr. Mornah’s suit filed by his counsel, Dr. Raymond Atuguba, Executive secretary of the defunct Constitutional Review Commission (CRC) on December 30, 2012 cites the Attorney-General as the defendant.

He is seeking a declaration that “on a true and proper interpretation of Articles 133, 157, 93(2) and 11 of the 1992 Constitution; Rule 71B, a portion of Rule 69C (5) and a portion of the Supreme Court (Amendment) Rules, 2012 (C.I. 74) are unconstitutional and must be declared null and void and of no effect.”

He also wants “any consequential orders” that the highest court of the land may deem fit.

Alhaji Ramadan said “I believe the party is not even aware that he has really gone to the Supreme Court to challenge it even though it is his right as a citizen of this land and we all pledge to uphold the sanctity of our constitution in this land.”

He set the record straight that the court case is not being sponsored by the PNC saying “it is not even known by the party so we can only say that we wish him well and if we go through with it, it is the country that will benefit.”
